Major online poker operators continue to accept Brazilian players despite a new government measure restricting online gambling in Brazil. PokerStars, GGPoker and PartyPoker remain available to Brazilian customers, apparently operating on the understanding that player-versus-player poker falls outside the scope of the restrictions.
The situation follows an executive order announced by President Luiz Inácio Lula da Silva ahead of Brazil’s general election. Although the measure targets fixed-odds betting products, including sports betting and online casinos, its implications for online poker initially remained unclear.
A week after the announcement, major poker platforms had yet to withdraw their services from the Brazilian market.
The distinction appears to be between traditional fixed-odds gambling and poker played directly against other players.
In fixed-odds betting, operators offer odds and take positions on the outcomes of events. In player-versus-player poker, participants compete against one another, with the operator typically providing the platform and taking a fee or rake.
PokerStars addressed this distinction in a statement to its Brazilian customers, saying that its player-versus-player poker offering was not covered by the measure. The company maintained that Brazilian players could continue using the platform as normal.
Other major operators have also continued offering poker, although not every company has issued a public statement explaining its interpretation of the new rules.
However, operators continuing to accept Brazilian players should not be taken as definitive proof that every form of online poker is legally exempt. The precise application of the measure remains an important question as the situation develops.
The executive order is set to remain in effect for 120 days and requires congressional approval to continue beyond that period. Industry observers cited in the original report expect the restrictions to remain a significant factor in Brazil’s gambling market.
The political situation adds another layer of uncertainty. Lula is seeking a fourth presidential term, facing a close contest against Flavio Bolsonaro, who has criticised the gambling ban as politically motivated and populist.
Following a closely contested first round of voting, a runoff between the leading candidates is scheduled for October 25. The election result could influence the future direction of gambling policy, although the precise consequences for online poker remain uncertain.
For poker operators, the distinction between regulated poker and other gambling products is commercially significant. Brazil is an important market for online poker, and continued access to Brazilian players would allow operators to preserve their existing customer base while sports betting and casino services face restrictions.
The stakes are substantial. According to the report, operators that illegally provide online gambling services could face criminal penalties, including up to six years in prison and a fine.
That risk makes it unlikely that major operators would continue serving Brazilian customers without carefully considering the legal implications. Nevertheless, their current decisions do not guarantee that regulators or courts will ultimately agree with their interpretation.
Players should therefore distinguish between an operator continuing to offer access and a definitive legal ruling that the activity is permitted. Regulatory guidance, enforcement decisions and the final treatment of poker under Brazilian law could still change the situation.
